DECIDR.AI Pty Ltd (ABN 99 673 841 284) ("Decidr", "we", "us") is committed to protecting personal information and will take all reasonable steps to secure the personal information it holds. A reference in this policy to Decidr also includes Decidr's wholly owned businesses and brands.

Decidr understands the importance of privacy and is committed to collecting and handling personal information in accordance with all applicable privacy laws. Decidr is committed to complying with:

  • the Australian Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APPs), and Australian specific privacy matters are set out in the privacy policy below
  • the Privacy Act 1993 (NZ) and the New Zealand Privacy Principles to the extent applicable, and NZ specific privacy matters are set out in the NZ Annexure
  • the EU General Data Protection Regulation (GDPR) to the extent applicable, and GDPR specific privacy matters are set out in the EU Annexure
  • the California Consumer Privacy Act (CCPA), to the extent applicable, and CCPA specific privacy matters are set out in the CCPA Annexure

Decidr may update this Privacy Policy and Annexures from time to time. The current version will be published on the Decidr website.

By visiting our website, using an application or otherwise dealing with us, you agree to this policy and you also agree to the collection of your Personal Information and also to our collection, holding, use and disclosure of your Personal Information in accordance with and as set out in this privacy policy and Annexures.

Types of personal Information Decidr collects

Personal Information means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not, and whether the information or opinion is recorded in material form or not.

The following Personal Information may be collected from you through your use of the website, platform or our applications (apps), services or other methods:

  • Contact information, such as first and last names, job title, email address and telephone number;
  • Financial information, such as bank account and payment card details where you are transacting with us, credit provider information such as credit score;
  • Device and browser information, such as network and connection information (including Internet Service Provider and Internet Protocol (IP) addresses), device and browser identifiers and information (including device, application or browser type, version, plug-in type and version, operating system, user agent, language and time zone settings and other technical information), advertising identifiers, cookie identifiers and information and similar data;
  • Account information, such as security-related information (including usernames, passwords and authentication methods);
  • Usage information, metrics and history, such as usage metrics, log files, content interactions and user journey history (including aged navigations, a list of URLs starting with a referring site, timestamps, content viewed or searched for and other data relating to your activity on the website, platform and the site you exit to);
  • User Content, information you upload or input into the Website, such as text, images, or any other data, including Decidr AI ecosystem interactions;
  • Organisational information, such as your employer or organisations of which you are a member, location, your status within an organisation, and similar data; and
  • Any additional applicable information you, your employer or other organisation wishes to disclose.

We also collect, use and share aggregated data such as statistical or demographic data for any purpose. Aggregated data could be derived from your Personal Information but is not considered Personal Information in law as it will not directly or indirectly identify you. However, if we combine or connect aggregated data with your Personal Information so that it can directly or indirectly identify you, we treat the combined data as Personal Information which will be used in accordance with this privacy policy.

We may collect Personal Information either through direct or automated interactions. We may also collect information about you from other sources which we may combine with Personal Information provided by you to help us update, expand and analyse our records and identify new customers. The Personal Information we collect from other sources includes identifiers, professional or employment-related information and may be obtained from third parties or public sources including (but not limited to) analytics providers, search information providers, social media profiles such as LinkedIn or from other individuals at your organization for one or more of the purposes as set out within this privacy policy.

Applicants for employment

If you apply for employment we may also collect and store information including your:

  • education, training and other qualifications;
  • work history;
  • professional or trade associations or union membership;
  • hobbies and other interests;
  • criminal history; and
  • personal statements about your attitudes to:
    •  life;
    • work;
    • relationships and
    • other workers.

We will collect, hold and use that information solely for the purposes of assessing your application. If you are successful, your information will become part of your record. If you are unsuccessful, we will keep your information on file for 12 months, and then delete it.

Current employees

If you are an employee, or a former employee, we collect all of the Personal Information noted above and in addition information about the training modules you have completed, the forms you have submitted, personal information you have provided, the approvals you have given or received, and other similar information related to your job.

Decidr AI-first business

If you reserve or purchase an AI-first business product we collect all of the above Personal Information about you and in addition:

  • company details including ABN and/or CAN;
  • financial information including bank account and credit card details, credit score and history, profit and loss statements, balance sheets, weekly takings information;
  • sales data; and
  • other business related information which may contain personal information

Sensitive information

Decidr does not collect sensitive information except as set out in this section or with your informed consent.

Why we collect Personal Information about you

Decidr collects Personal Information about you for the following primary purposes:

  • to provide you with our services including access to our Decidr platform;
  • to provide you with recommendations, suggestions and services;
  • to verify your identity;
  • to send you information and updates pertaining to our services;
  • for essential communications, such as emails, accounts information, AI technology chat and critical service details;
  • to send you promotional, marketing or other information about our services and/or events through email, postal mail, AI Technology chat or some other means unless you instruct us not to;
  • to process any inquiries you have about Decidr, our services or events;
  • to conduct research about our services, including but not limited to in areas such as artificial intelligence and machine learning;
  • to aggregate data and/or produce aggregated and anonymised analytics and reports, and provide this anonymously to our customers, share publicly or with third parties; or to respond to your feedback or complaints;
  • the administration of agreements to which you or we are a party and to assess compliance with them and benchmark performance;
  • the consideration of any application by you;
  • to ask about your experiences with or impressions of services supplied by us or to you or in respect of which you have made enquiries;
  • to conduct surveys and assess market trends;
  • to improve website functionality or useability;
  • to facilitate the operation or functionality of operational, administrative, information and other systems and procedures;
  • to assist with audits, reviews, investigations or enquiries concerning services supplied by us or to you or otherwise;
  • the administration, management or improvement of our business;
  • for internal research and development for new content, products, and services, and to improve, test, and enhance the features and functions of our current services;
  • to use data analytics to improve our website, applications, services, marketing, customer relationships and experiences;
  • for purposes outlined in policies, procedures or manuals;
  • to share between our related bodies corporate for any of these purposes;
  • to exercise, enforce, take lawful action in respect of, secure or perfect any right or agreement;
  • to detect and prevent fraud and abuse to ensure the security and protection of all customers and others, as well as to identify and authenticate your access to the applications and our services or to identify and authenticate you before we provide you with certain information;
  • to search public records or registers, or to register information or an interest thereon;
  • for any potential or actual sale, transfer, merger, acquisition, restructure or other dealing in respect of our business or assets;
  • to share your information with other organisations whether or not part of our group (including businesses, suppliers, service providers, associates and other external parties whatsoever) for these purposes (and this includes disclosure to the counterparties and other organisations for such purposes and we refer you to their privacy policies);
  • any purpose requested or consented to by you;
  • any purpose required, authorised or permitted by law;
  • for compliance with any law including the National Consumer Credit Protection Act, Privacy Act, Anti-Money Laundering and Counter-Terrorism Financing Act and any other law whatsoever;
  • as part of the Decidr AI ecosystem forum for Decidr AI customers and wider, to collaborate, discuss and provide user insight into Decide AI and its products;
  • for cross-sell marketing activities to existing customers of Decidr AI’s wider product suite. These may have been identified as relevant or applicable from previous purchases and/or interactions with Decidr AI; and
  • any purpose referred to in this policy.

How we collect Personal Information from you

Decidr collects personal information about you in a number of ways, including directly from you when you:

  • use our websites (including Decidr.ai), social media pages, and internal websites or intranet (Website);
  • use our mobile and tablet apps, including the Decidr app (Apps);
  • interact with us and provide personal information by any other means, including either physically or electronically;
  • are present at or outside our premises, including images, video and audio from CCTV, other cameras (including body cameras), and other security and recording systems;
  • use physical, electronic or online forms;
  • contact us via email;
  • contact us via telephone or facsimile;
  • enquire about our goods or services or about becoming our customer, or if you become our customer, in relation to any goods or services;
  • make enquiries about or apply to become a licensee, platform user, employee, independent contractor, supplier to us or an AI business user;
  • provide us with your personal information in relation to a competition, promotional campaign, requesting a quote, make a complaint or for any other reason;
  • apply to join and participate in a loyalty program;
  • apply for or accept grants or other assistance from us; and
  • otherwise deal with us.

Decidr may also collect Personal Information about you from other third party sources when it is impractical or unreasonable for us to collect it directly from you. These sources may include:

  • a credit reporting body;
  • someone authorised by you such as an agent, broker, accountant, solicitor, attorney, financial counsellor, introducer, business colleague, associate, family member or guarantor;
  • a social media platform (e.g. Facebook, Instagram);
  • where you have consented to a third party disclosing your personal information to us (e.g. when you enter a competition or promotion run by a third party for us);
  • where it is lawful for a third party to disclose your personal information to us;
  • a referee;
  • an employer (current or former);
  • a government body (including law enforcement);
  • financial institution;
  • a professional or trade association or trade union;
  • a manufacturer or distributor of any products or services supplied by us, purchased by you or in respect of which you have made enquiries or which you get serviced or repaired with us;
  • our agents such as commercial agents, debt collectors or solicitors; and
  • we also collect personal information about you from third parties, including when:
    • you choose to create an account or register for a product or service via a Website or App using a social media platform (e.g. Facebook, Instagram);
    • you have consented to a third party disclosing your personal information to us (e.g. when you enter a competition or promotion run by a third party for us); and
    • it is otherwise lawful for a third party to disclose your personal information to us.

We also collect personal or anonymous information about you from other sources and sometimes combine that information with other information collected from you or from third parties for the purposes disclosed in this privacy policy.

We may collect the information in person, over the telephone or internet, by mail, fax, email or camera, through social media or biometric reader, by other electronic means or by completion of an application or consent form, whether on-line or otherwise. We may also purchase it from third parties if lawful to do so.

We also collect personal or anonymous information about you from other sources and sometimes combine that information with other information collected from you or from third parties for the purposes disclosed in this privacy policy.

When collecting Personal Information by whichever means, Decidr will take reasonable steps to provide the appropriate notices and obtain relevant consents in accordance with privacy laws. We may keep unsolicited personal information (personal information we receive that we have taken no active steps to collect) if the information is reasonably necessary for one or more of our functions, services or activities.

Disclosure of Personal Information

Decidr may, from time to time, disclose your Personal Information to:

  • our employees, affiliates, controlled entities, contractors (or sub-contractors) or other third party service providers in order to provide our services, including (but not limited to) IT service providers, cloud providers;
  • the Decidr AI ecosystem;
  • third party conference or event organisers;
  • our professional providers or advisors (e.g. lawyers, accountants, business advisors);
  • third parties with whom Decidr has sponsorship, commercial or other contractual arrangements with to provide services or benefits to Decidr or Decidr franchisees
  • marketing, business or other related purposes;
  • credit reporting agencies, courts, tribunals and regulators
  • research institutes, laboratories;
  • marketing platforms;
  • any other individual or third party for any authorised purpose with your consent or when authorised or required by law; and
  • If Decidr merges with, is acquired by another company, or sells all or a portion of its assets, your personal information may be disclosed to our advisers and any prospective purchaser’s adviser and may be among the assets transferred

Decidr may disclose personal information for secondary purposes that are related to the primary collection purpose but only in situations where it is reasonable to expect such information to be disclosed.

You do not have to provide us with your Personal Information

You don’t have to provide any Personal Information to us. However, if you do not do so, this may affect or completely restrict your ability to use our products and services, including our websites or app, our ability to provide you with relevant content, prizes, products and services, or our ability to process your queries and employment applications.

How we secure your personal information

We use reasonable endeavours to secure your personal information which may include:

  • maintenance of a secure environment for storage of information;
  • requiring that access to such information be confined to authorised personnel; and
  • using technology such as encryption or password protection to secure information.

We require other entities that collect your information from us to use reasonably available technology to secure it.

We are not responsible for the security of any computer, mobile phone, tablet computer or other device whatsoever which you use to access our website or to communicate with us and through which we provide communications to you.

Cookies, analytics and platforms

Our websites use cookies to provide the functionality necessary to deliver our products and services. Our websites also use a number of third party services such as analytics and security that also utilise cookies. We do not control these third parties or their cookies and we refer you to the third party’s website for details on how they use their cookies.

Cookies in use may identify individuals who log into our website. You can reject cookies as described in our Cookies Policy.

We may use tracking technologies to collect personal information about you when you use and access a website or app, including cookies, internet tags or web beacons, and navigational data collection (e.g. log files, server logs, and clickstream data). The type of information that is collected includes:

  • type of device being used to access the website;
  • country where user is located;
  • time on a page;
  • bounce rate - the number of users that enter and leave the same page (expressed as a percentage);
  • channel; and
  • other metrics as required.

Decidr uses:

This browsing information is generally not linked to your identity, except where you access a website or app via links in a message we have sent or where we are able to identify the device or user accessing a website or app.

We may combine your anonymous information, browsing information or other information collected through tracking technologies with your Personal Information collected as described above in order to understand and remember your preferences and interests.

Mobile platforms such as iOS and Android may define certain types of information or data that our Apps cannot access without your consent. Each platform has its own permissions system for obtaining your consent. For example, the iOS platform may alert you the first time an App wants your permission to access certain types of data (e.g. location services) and will provide you the option to consent to that request.

Android devices may notify you of the permissions that an App seeks before you first use the App and your subsequent use of the App constitutes your consent.

You can manage your platform level permissions via the Settings section on your device. For more information, please contact your device provider or refer to the user manual for your device.

Consent

You hereby provide your fully informed consent to the collection, use, disclosure and storage of your Personal Information as described in this Privacy Policy.

You can withdraw your consent at any time by notifying the Privacy Officer as described below.

Cross border disclosure of Personal Information

Your Personal Information may be disclosed to overseas recipients as part of our ordinary business or normal use of our information technology systems. We may disclose your Personal Information overseas for the purposes of provision of services, marketing, IT services, accounting, support and maintenance, merger and acquisition activity, research and other purposes.

Some of our operations, related entities and/or third party service providers are located in countries outside of Australia (including but not limited to United States of America, United Kingdom, Countries located in Europe and in Asia (Recipient Countries).

When we disclose your Personal Information to any overseas recipients, we shall do so only for purposes listed in this Privacy Policy and in accordance with applicable privacy laws.

Direct Marketing

Marketing Decidr products and services is important for us to fulfil our role. We use a number of direct marketing strategies and channels including email, mail, SMS, social media and third party marketing companies to provide you with information relating to our products, services, promotions, publications or other products or services that we reasonably think may be of interest to you.

We will provide you with a way of opting out of receiving direct marketing communications or you can opt out by contacting our Privacy Officer as described below.

Decidr’s franchisees may use similar marketing strategies and channels as Decidr. 

Except as set out in this Privacy Policy, Decidr will never sell, trade, lease or rent any personally identifiable information to other organisations except as stated and agreed by you when we collect your Personal Information.

How you may access your personal information

Any request for access to your Personal or Sensitive (if any) Information held by us must be sent by email or post to our contact details referred to below under the heading 'Our Contact Details'.

If we are unable to grant your access, we will give you our reasons in writing within a reasonable time. These may include where providing the information to you may:

  • reveal personal information about another individual person;
  • pose a threat to the health or safety of another individual person;
  • not be permitted by law; and
  • reveal information of a commercially sensitive nature which is not required to be disclosed to you by Australian Privacy Law

There may be a charge to make a request for access to your information.

We cannot give you access to credit information held about you by an external party whether that body obtained the information from us or not. We refer you to the privacy policy of that body.

How you may correct any personal information we hold about you

If you believe any Personal Information we hold about you is incorrect, please contact us to the contact details referred to below under the heading 'Our Contact Details' and tell us what information is, in your belief, incorrect and how you want it changed.

We will deal with your request according to applicable privacy laws. If we receive a request for access or correction, we will provide our response and/or complete any reasonable action within the timeframe required by law.

If we have supplied credit information which we have agreed to correct to a credit reporting body, we will notify that body within the timeframe required by law. AI business privacy policies:

  • Many Decidr AI businesses in the Decidr AI ecosystem are owned and operated by independent businesses. Some of those businesses also operate websites and have their own privacy policies.
  • Decidr does not control the use or disclosure of personal information and may not have access to the personal information held by Decidr AI businesses.
  • Decidr AI businesses are each independently responsible for ensuring that your personal information collected by them is handled in accordance with the Australian Privacy Principles

We may make changes to this Privacy Policy from time to time for various reasons including:

  • changes to the law;
  • changes to technology; and
  • changes to our business practices, procedures or systems.

NZ ANNEXURE

Decidr New Zealand Privacy Policy

This Annexure is to be read in conjunction with the Privacy Policy above and provides additional privacy information as required under the Privacy Act 2020 NZ, as to how we collect, hold, use or otherwise process the personal information of individuals who are located in New Zealand. Decidr is committed to upholding these practices when dealing with the personal information of NZ residents.

The Decidr Privacy Policy set out above (in terms of the Australian Privacy Policy) sets out how Decidr collects, uses and discloses Personal Information subject to the New Zealand privacy laws. Any differences between NZ and AU privacy requirements are set out in this NZ Annexure.

New Zealand Privacy Policy: In New Zealand, privacy is governed by the Privacy Act 2020 NZ. This Act regulates the collection, use, and disclosure of personal information by public and private sector agencies. The Office of the Privacy Commissioner (OPC) is responsible for enforcing privacy laws in New Zealand.

Definition of Personal Information:

New Zealand Privacy Policy: Personal information is broadly defined under the Privacy Act 2020 and includes any information about an identifiable individual. This includes information relating to a living individual from which they can be identified, either directly or indirectly.

Principles and Requirements:

New Zealand Privacy Policy: The Privacy Act 2020 sets out 13 privacy principles that guide the collection, use, storage, and disclosure of personal information by agencies in New Zealand. These principles are similar in many respects to the Australian Privacy Principles.

Regulatory Authority:

New Zealand Privacy Policy: The Office of the Privacy Commissioner (OPC) in New Zealand is responsible for overseeing compliance with the Privacy Act 2020. It provides guidance, investigates complaints, and promotes awareness of privacy rights.

Cross-Border Data Transfers:

New Zealand Privacy Policy: The Privacy Act 2020 similarly regulates the transfer of personal information overseas. Agencies must ensure that adequate protections are in place when transferring personal information to countries that do not have comparable privacy laws.

GDPR ANNEXURE

This Annexure is to be read in conjunction with the Privacy Policy and provides additional privacy information as required under the GDPR, as to how we collect, hold, use or otherwise process the Personal Data of individuals who are located in the EU or the European Economic Area (EEA). Decidr is committed to upholding these practices when dealing with the Personal Data of EU residents.

For the purposes of this Annexure, Personal Information will also include ‘Personal Data’ as defined in GDPR.

When Decidr is primarily the 'controller' of Personal Data, Decidr will provide its services in a way such that Personal Data will be processed fairly, lawfully and in a transparent manner, and collected and processed only for specified and lawful purposes.

Legal bases for processing

Decidr will only collect and process your Personal Data where we have legal bases for doing so. Depending on the services you seek or use, Decidr may rely on the following legal bases for processing Personal Data:

  • when it is necessary for the performance of a contract to which you are a party, or to take steps at your request, or to respond to your inquiries before entering into such a contract;
  • where you give consent to process your Personal Data for a legitimate purpose;
  • where there is a legitimate interest for Decidr to process the Personal Data (e.g. to protect our legal rights and interests); and
  • where Decidr must process the Personal Data to comply with its legal obligations.

In addition to the purposes set out in section 2 of the Privacy Policy, Decidr may process your Personal Data:

  • to communicate with you and conduct our activities, including to respond to your inquiries, complaints or feedback;
  • for quality assurance purposes, and to assist with compliance of applicable laws and regulations;
  • to verify your identity when you interact with us, including when you seek access to information that we hold of you;
  • subject to Decidr obtaining your consent (to the extent consent is required or relied upon as a legal basis), for the purposes of sending marketing or promotional materials or communications (including emails) for our products and services or events, including those from our sponsors or partners; or
  • as required or authorised by law.

If you have consented to our use and processing of your Personal Data for specific purposes, you have a right to withdraw your consent at any time.

Third parties will only process your Personal Data in accordance with Decidr’s instructions and where the third party complies with the GDPR requirements or other data protection laws for the processing and transfer of Personal Data.

Profiling and automated processing of Personal Data

Decidr does not make decisions or predict personal aspects of an individual using automated processing of Personal Data. However, we may collect certain information from you in relation to your website visits and online activity. This may in some circumstances constitute ‘profiling’ under the GDPR. Furthermore, Decidr may undertake ‘profiling’ to personalise your website experience, our communications with you and improve our service offerings to you.

Cookies

Our websites use cookies to provide the functionality necessary to deliver our products and services. Our websites also uses a number of third party services such as analytics and security that also utilise cookies. We do not control these third parties or their cookies and we refer you to the third party’s website for details on how they use their cookies.

Cookies in use may identify individuals who log into our website. You can reject cookies by changing the settings on your browser but doing so may limit your functionality and user experience within our site. For further information, please refer to our Cookies Policy.

Direct marketing

Decidr will not use direct marketing as outlined in the Privacy Policy to market its products and services to you unless:

  • Decidr has received express consent from you to use your Personal Data for that purpose; or
  • as otherwise permitted by law.

If an individual has agreed to receive marketing, the individual may always opt out at a later date. Refer to the Privacy Policy for the process in which this can be done.

Transfers outside the EEA

Transfers and storage of an individual’s Personal Data outside the EEA are subject to different binding information protections regulations and specific contractual obligations. In the circumstance when Personal Data is transferred outside the EEA, in addition to the procedures and safeguards used to secure Personal Data set out in the Privacy Policy, the Decidr will also implement other appropriate safeguards in accordance with the GDPR which may include:

  • binding corporate rules;
  • standard data protection clauses; or
  • entering into contractual clauses with the recipient of the individual’s Personal Data which will provide an individual with enforceable and effective rights.

Correct, update or delete Personal Data

You have the following right to request:

  • the correction of Personal Data that Decidr holds of you that you believe to be incorrect;
  • the completion of Personal Data that Decidr holds of you where you believe this is incomplete; and
  • the deletion or erasure of certain Personal Data, in certain circumstances and in accordance with our obligations under the GDPR.

Your rights regarding your Personal Data

You have the right to:

  • access a copy of the Personal Data Decidr holds about you;
  • obtain from Decidr further information as to details about the processing of your Personal Data, including the purposes of the processing;
  • obtain from Decidr a copy of the Personal Data that Decidr has collected about you;
  • withdraw consent where Decidr is processing your Personal Data based on that consent;
  • object to the processing of your Personal Data in the particular circumstances outlined in the GDPR;
  • restrict or limit how Decidr processes your Personal Data in the particular circumstances outlined under the GDPR;
  • have your Personal Data transferred to you or a third party a portable format, in the particular circumstances outlined in the GDPR; and
  • request the erasure or deletion of Personal Data held of you by Decidr (in certain circumstances).

Please note that in some cases, we may then be unable to offer or provide our services to you once we process your request. If you ask us to restrict the collection or use of your Personal Data, we will let you know how the restriction may affect the services we can provide to you.

In addition, your objection to certain processing may not be granted if Decidr believes it has legitimate grounds to process Personal Data which overrides your rights and freedoms under the GDPR.

Requests and complaints

Requests

You can exercise your rights by contacting our Privacy Officer. When Decidr responds to a request under this Annexure, Decidr may not refuse to act on the request, unless it can demonstrate that it is not in a position to verify you or we are not obligated to do so by law or the GDPR.

We will otherwise endeavour to respond to your request in a timely manner and within one month of receipt of the request. This period may be extended by two further months where necessary, taking into account the complexity and number of the requests. Decidr will inform you of such an extension within one month of receipt of the request, together with the reasons for the delay.

If Decidr decides not to take action in response to your the request, we will inform you of our decision within one month of receipt of the request, provide our reasons for not taking action, and provide you with details on how you may lodge a complaint with a supervisory authority and seek a judicial remedy, if you are dissatisfied with the outcome.
